Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your use of the beanaccount website, software and related services (together, the "Services"), provided by beanaccount ("beanaccount," "we," "us" or "our"). By creating an account or using the Services, you agree to these Terms. If you are using the Services for a business or organization, you agree on its behalf and confirm you are authorized to do so.

2. The Services

beanaccount provides online bookkeeping tools, including a self-serve ledger, financial reports and related features, and may offer optional paid services such as full-service setup, monthly reconciliations and consultations. The features available, and the fees for any paid services, are described on our website or agreed with you in writing.

3. Best efforts, no guarantees

We provide all Services, including any bookkeeping, reconciliation, setup or consulting work, on a best-efforts basis. We aim for the Services to be available, accurate and reliable, but we do not guarantee that they will be uninterrupted, error-free, or free of data loss, or that any report, calculation or result will be complete or correct.

To the fullest extent permitted by law, the Services are provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.

4. Security

We use reasonable, best-efforts measures to protect your account and data, such as password protection, encrypted connections and restricted access to stored files. However, no system is completely secure, and we cannot guarantee that unauthorized access, loss or disclosure will never occur. You are responsible for:

• keeping your password and any read-only login passwords confidential, and choosing who you share them with;
• telling us promptly at support@beanaccount.com if you believe your account has been accessed without your permission;
• not storing sensitive information you don't need, such as full bank account, card or Social Security numbers.

5. Your data and your responsibilities

• Your books are yours. You own the data you enter. You can download your ledger at any time, and we encourage you to keep your own regular backup copies.
• Accuracy. You are responsible for the accuracy and completeness of the information you enter and for reviewing your books and reports.
• Not professional advice. The Services are bookkeeping tools and services. Nothing we provide is tax, legal, audit or investment advice. Please consult a qualified professional before relying on the Services for tax filings or other important decisions.
• Our use of your data. We use your data only to provide and support the Services, and we do not sell it.

6. Acceptable use

You agree not to misuse the Services, including by attempting to access other users' accounts or data, interfering with the operation or security of the Services, using them for any unlawful purpose, or reselling them without our written permission.

7. Fees for paid services

The basic self-serve Services are currently free. Paid services are billed as described when you sign up for them. We will give you at least 30 days' notice of any change to the fees for a service you are using. Fees already paid are non-refundable except where required by law or where we agree otherwise.

8. Ending your account

You may stop using the Services and close your account at any time by writing to support@beanaccount.com. Please download a copy of your ledger first. We may suspend or close an account that violates these Terms, and where reasonable we will tell you why and give you an opportunity to download your data.

9. Changes to the Services and to these Terms

We will give you at least 30 days' notice before we make any material change to the Services, or to these Terms, and before we discontinue any service, in whole or in part. Notice will be sent by email to the address on your account and posted on our website. If a service is discontinued, your data will remain available for download for at least the 30-day notice period. Continuing to use the Services after a change takes effect means you accept it.

Exceptions. We may make a change sooner, or immediately, when it is needed to protect the security or integrity of the Services or your data (for example, to fix a security vulnerability or respond to an attack or misuse), or when it is required by law, regulation, court order or a government authority. In those cases we will give you as much notice as we reasonably can, and will tell you about the change and the reason for it as soon as practical.

10. Limitation of liability

To the fullest extent permitted by law, beanaccount will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits, revenue or business opportunities, arising from or related to your use of the Services. Our total liability for any claim relating to the Services is limited to the amount you paid us for the Services in the twelve (12) months before the claim arose, or one hundred U.S. dollars ($100) if you paid nothing.

11. Indemnity

You agree to indemnify and hold beanaccount harmless from any claims, losses and expenses (including reasonable attorneys' fees) arising from your misuse of the Services or your violation of these Terms.

12. General

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules. If any part of these Terms is found unenforceable, the rest remains in effect. Our not enforcing a provision is not a waiver of it. These Terms, together with any written agreement for paid services, are the entire agreement between you and beanaccount about the Services.
